Terms & Conditions
1. Services
Arabzadah Advisory provides marketing and brand advisory services, including brand strategy, marketing consulting, content and campaign development, and digital growth support. All services are advisory and strategic in nature. While we bring experience and diligence to every engagement, we do not guarantee specific business outcomes, revenue, or results, as these depend on factors outside our control.
The specific scope, deliverables, timeline, and fees for each engagement are defined in a separate written agreement or statement of work agreed between Arabzadah Advisory and the Client before work begins.
2. Payment Terms
- Unless otherwise agreed in writing, payment is due upon completion of the agreed services, following the issuance of an invoice.
- Invoices are payable within 30 days of the invoice date.
- No deposit or advance payment is required to begin an engagement, unless expressly agreed in writing for a specific project.
- All fees are quoted and payable in Canadian dollars (CAD) unless otherwise stated.
3. Refund Policy
Because no upfront payment is taken, our refund approach is structured around a void-engagement principle rather than a traditional refund:
- Following an initial consultation, if we determine we cannot appropriately serve the Client's needs, we may declare the engagement void before any billable work proceeds, and the consultation is provided at no charge.
- Fees for services that have been completed and delivered are non-refundable, given the time, expertise, and strategic work involved.
- Where any advance payment has been agreed for a specific project, refunds apply only to work not yet performed at the point of termination.
4. Revisions & Scope
We want you to be satisfied with the work. Revisions are provided within the boundaries of the agreed scope:
- Revisions refine or adjust deliverables within the originally agreed scope of work.
- A scope change is any request that adds new deliverables, expands objectives, or materially alters the direction agreed at the outset. Scope changes may require a revised timeline and additional fees, agreed in writing before proceeding.
- We will always flag when a request crosses from revision into scope change, so there are no surprises.
5. Dispute Resolution
If a concern arises, we ask that it be raised with us directly and in good faith before any external action is taken. Our process:
Clients agree to contact Arabzadah Advisory in writing to resolve any concern before initiating a payment dispute or chargeback.
6. Intellectual Property
- Upon receipt of full payment, ownership of final deliverables created specifically for the Client transfers to the Client.
- We retain ownership of pre-existing frameworks, templates, strategic methodologies, and tools used to deliver the services, and grant the Client a non-exclusive license to use them as embedded in the final deliverables.
- We may reference completed work in our portfolio and marketing materials unless the Client requests confidentiality in writing.
7. Governing Law & Termination
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Either party may terminate an active engagement with 14 days' written notice. Fees for work completed up to the termination date remain payable, and the Refund Policy in Section 3 applies to any prepaid, undelivered work.
